I think its certain loans that will allow you to use it. . you also have to qualify for it. FI didnt use it for his down payment, but he did get it. I think if you have a realtor, they should be able to help you figure out if you could use it or not :)

We purchased our house in July and were told that you had to actually buy the house first, then you're eligible for the credit. We bought the house then did an amended tax return and got the credit 5 weeks later.

Katherine - since you weren't married yet, did you each just claim $4000? We may not file jointly since we will only be married a mont of 2009.

we just closed last week and you have to buy the house first in order to get the credit. you have to include your closing statement when you ammend your return or file your new return next year in order to get the credit.
