'splain this to me

Lines are installed at a jobsite (phone, cable) within a slab of concrete.  Contractor comes along and removes concrete and rips up lines.  Installation of lines in concrete is incorrect.

Who is at fault?

    Was the ripping up of the concrete the cause of the lines not working or was it the consequence of the lines not working?

    I'd say whoever laid the lines is at fault, but I didn't know you could lay lines in concrete (and have them still work after the cement dries), so I'm not much help

    It's a common issue and companies claim negligence on the part of the removal of the concrete.

    well, i'd *assume* that the contractor was just doing what what was specified. Maybe he didn't have up to date drawings/was not aware of the presence of the lines.

    Oh they were located, but specs to install cable/phone is 36" underground.  Therefore...

    was there a depth specified on the job description?

    i.e. remove existing sidewalk and driveway to a depth of 6 "

    Yes, exactly, and the job was performed to spec. 

    Silly Qwest.  They send bills to collections and I tell the chick that the cable was intalled IN the concrete that was to be removed.  And that it was technically unavoidable....*silencecrickets* "Well that was negligence on your part".

    Okay...I'm gonna let you go...ok?

    haha - love it. I get complaints from my plants about stuff like this - they only give partial info, the contractor does the work based on what is specified, the site complains because something goes wrong - they want the contractor's head on a platter, and then call me to complain. 

    "well, did the drawings include that info?" 
    "no"
    "then how is it the contractor's fault?"

    I mean, if we hit something that is OUR fault, we pay.  And quickly.  But some companies *QwestCOUGH* don't investigate at ALL, and then send bills.

    We got one the other day for permit of installation of a gas line.  We don't INSTALL gas lines.  :-/
