HR Question

My old job had a website where we could login and get payroll and W-2 info.  I left the company 5 months ago.  I logged on because I wanted to run an estimate of our tax situation for this year.  Well, they had a paycheck listed that I never received.  It was about $150.  We were paid once a month, and I closed my bank account to which my paychecks were being direct deposited after I received what I thought was my last paycheck (I've been using our joint checking account exclusively since I got married, and the last thing I was waiting for to close that old account was my last paycheck).Now, I'm not surprised that they stumbled across a $150 error 3 months after I left, nor am I surprised that the idiots DDed it rather than mailing it to the address they had on file.  What should I do now?  The company has since moved, plus their payroll guy is a douche.  He ignored my emails and calls when I worked there, so there's no way in hell he'll return my calls now.  I checked the NC unclaimed property website, and my claim wasn't listed.  I'll contact the company if that's my only recourse, but I have a feeling they won't be very helpful.

  • Unfortunately, I think your first step does need to be to contact their payroll department.
  • Blah.  That's what I was afraid of.Maybe they won't pay it and I can sue them for everything they are worth.  Muhahahahaha.

  • You will likely also need proof from the bank that your account was closed and you didn't receive that deposit.

  • The check should eventually go the unclaimed property website, if the company properly handles it (escheat).  But that takes a long time - could be a year before they legally have to send it to the state.  They do have to make an effort to get the funds to you first - but it doesn't sould like they will try too hard to do that.  You'll probably have to contact them, maybe by certified letter.

  • Call payroll, if he doesn't return your calls, then go higher (CFO, whoever) or call HR. It should have been mailed to you, so you've kind of got them by the balls for not trying that after the DD came back. At least in Nebraska, it won't go into unclaimed property until it hasn't been claimed for around 2 years, so you might be waiting for awhile if you go that route.

  • Contact the payroll department, inform them you never received your last paycheck, and would like it mailed to you or direct deposited into another account. Either contact a live human being with this information, and get a time frame on a response, or send a registered/certified letter with proof of receipt. If you get no response to that, contact your government labor agency (should be under state, but may be called different things in different states). Ours is the "Texas Workforce Commission", found in the govt listings in the phone book, under "state govt". If they reporte to the IRS that they paid you, and never actually did, then it might could be considered fraud, whether it was intentional or not. If you ever had to play hardball, threaten them with reporting it to the IRS. Hopefully a phone call or letter will be sufficient.
