Over the summer we had a customer at our family business where I work buy a rather expensive lawnmower. He was a jerk from the start, coming in every day trying to haggle when we told him that the price is fixed. He even came in when my parents were off and told me that they had promised him a lower price and he wanted to take it right away, I was suspicious and later found out that they never agreed to that price.
He eventually bought the mower for a good price, less than we would probably be able to get for it, but we were glad to move it. He brought it back several times a week for the next couple weeks. He complained that the mower didnt work. The first time he didn't know how to start it, one time it needed an adjustment and was not charged, he would say it wouldnt work, but every time he brought it in, we checked it out and it ran fine. He even said it only happened in his yard, so we offered to go to his house and cut the grass to see if we could duplicate his complaints.
He didnt like our offers and wanted all his money back. The mower was used most of the summer, so we offered 75% of his money back because we would have to sell it as used. He didnt like that either, he filed a complaint with the JP.
There is a new JP who we have never been to, but we figured it was pretty straightforward. We were shocked when we got the ruling back and it was found in his favor to get his money back, which sucks, but we could sell the mower, right? NO! There was nothing in the ruling about giving the mower back, so they guy gets the money and gets to keep the mower. We are appealing the ruling, I can't believe this happened. The JP was actually a customer of our and was in the computer as returning a special order part for a credit, I think he might be holding a grudge that we didnt give him his money back.
I suggested that we not only appeal to a higher court, but make a complaint about the JP. If we have anymore lawsuits, we will have to go back to him. I think him being a former customer is a conflict of interest and we should be able to have the hearing in another district. WDYT?
