News Flash! Supreme Court Justice John Paul Stevens Retiring!

No link yet, because I just saw it flash on my TV screen.

Thoughts? This means Obama gets to pick a new judge for the court.

Re: News Flash! Supreme Court Justice John Paul Stevens Retiring!

  • I just saw that too!

Should be interesting to see who he picks, but honestly I doubt things will change much.  Obama will probably pick a judge with pretty similar values since he was usually a more liberal justice.
  • Oh good, another thing for FFIL to bitch and moan about.

  • The rumors had been starting a few weeks ago so it's not surprising.  He is quite old so it is very reasonable.  It also isn't a huge "loss" for conservative people because Stevens is quite liberal so whoever President Obama picks won't be a huge change or shock.

  • Historically, only 12 nominees have been rejected so it doesn't happen that frequently. Obama will definitely nominate someone with similar values. I just can't see him going with someone more conservative.

  • I'm not surprised, has there been any announcement of who Obama is interested in?  I haven't seen anything about that yet.

  • I saw the preliminary stuff about this a few days ago.  The pundits didn't seem to think Obama would have trouble getting his nominee, regardless of where they fall on the political scale, confirmed.

  • Pundits from which "side," squirrly? I try to get my news from Fox and NPR, figuring that the truth lies somewhere in the middle of the 2.

There have been rumors about Cass Sunstein, a professor at UChicago Law.

Agreed.  There is no reason why he shouldn't choose someone with his same philosophy.  I don't foresee there being any issue in passing.  People will make a big deal about it like they did with Sotomayor but nothing is going to come of it.  Just ruffled feathers.

  • I don't know who I was watching, Sara.  They were arguing about how liberal he is, how that's changed over time, but all agreed that the nominee would be confirmed.

  • If only Scalia would go that route . . . maybe JPS can send him postcards from his retirement home, telling him how great it is . . .

Nah, I predict Ginsburg will be next to go, even though I LOVE her and it would make me sad.

True story: FI met Scalia in a bathroom at some Federalist Society event once.  He tried to defer and let Scalia go in front of him in line but he wouldn't.  Scalia was grumbling about how much he hated video montages at dinners.

I would love to see a President nominate someone moderate for a change. We need more women and minorities as well.

Another Sandra Day O'Connor (sp?) would be nice, eh?

That would be nice but what incentive would a president have in doing that?

  • He IS 90.

I think it's great Obama gets another pick, but only the liberal justices will retire while he's in office, if at all possible. I think Ginsburg will be next. Unless something devestating happens to one of the conservative justices, the balance on the court will remain the same.

  • Isn't Ginsburg in fairly bad health?  It would only make sense for her to retire perhaps towards the end of his administration (if she can wait that long) so that he can make another choice.

She's had treatment for cancer in the past. During the Bush administration she said she was waiting for a Democrat to be elected before retiring. Which is why I expected her to be out by now!

<div>Ideally, it would be in the interest of justice, not politics.  I rather like Elena Kagen.  It also looks like women ARE making up a significant number of the top picks, yay!</div><div>
