Engagement Party RSVP drama

My brother and SIL have been gracious enough to throw us an engagement party for Sept 3rd, paper invites as well as evites went out over a month ago.

Out of 60 invites we have received 38 back, not bad right? So since my brother does not know a mass majority of these individuals who have not responded and the RSVP date passed on the 5th, he asked FI and I to get a-hold of them and ask them to either RSVP via telephone or e-mail. Easy right? Not so much, so far FI has been getting a lot of "oh well I might have to work, i think i have plans that day, i'll get back to you in a few weeks, etc" answers. (And the part that upsets me the most, all these answers are from his family).
No, sorry, you can't get back to me a in a few weeks, I need a yes or no now being that he has hired a caterer for this event and needs an exact number in order to have the food made and delivered.

I honestly hate being rude with these people, but do I have the right to say my brother is marking you down as a NO if we don't get a solid answer by the end of Tuesday?

Oh and to edit, I would never expect someone to take off work to come, i know not everyone can afford a day off but it's more of the "up in the air answers" that are bothering us. And yes i know, get used to it, it will be worse for the wedding RSVP's.
