need some help please

The videographer I used was a friend of a friend. He's a film student at St. Cloud University in MN. A few days after the wedding he sent me an email with a link to our highlight video, and said he'd have the final video done by the end of the week. Well that was about a month and a half ago. I still don't have the videos I was promised and have not even heard from him. I've sent him 2 emails and when that didn't work I sent him 2 messages via Facebook. I still haven't heard a word from him. I really don't think he's the type to take my money and run. I think he's just lazy. I've finally decided to send him one final letter before taking him to small claims court. I've drafted a letter but am unsure if it sounds ok. Any suggestions/comments will be much appreciated. Thanks, ladies!Dear Joe,    After exhausting all resources in trying to contact you, I am sending a final request. Since you have not met the agreements listed in our wedding contract and have not provided the wedding video that has been paid for and promised to me, I have no other choice but to take you to small claims court to receive the final product or repayment. If I do not receive either a response to this letter or the wedding video by August 3, 2009, I will accept that as your understanding of the possibility of small claims court.     I think the letter sounds fine. This may be a stupid question, but have you also tried calling him? Is it possible he hasn't been able to get online for some reason or another? Did you have a contract with him? Sorry you have to deal with this, that sucks!

    I called him today so we'll see. And no, I'm an idiot and didn't really do a contract. I have a ton of emails that outline what would be in a contract though. I'm hoping I don't have to take him to court- but just threatening him with it will get his butt moving on this.

    Also, if you didn't sign a contract with him, I doubt you will have much luck in small claims court. Your word against his sort of thing. Good luck!

    Just be sure to save the emails. I'm a nerd and watch Judge Judy and Peoples Court and crap all the time and even just a legit email stating intentions is enough to get the verdict. It's worth a shot at least. I think the letter sounds fine, hopefully it gets the job done.

    If you do send it, make sure to send it certified mail. This way there is proof that he received it.
