Vendors who break contract

I can't get in touch with one of my vendors. My DJ to be exact. I've gone by the office and it is always closed and they won't return any of my calls or e-mails. I have put down a deposit and signed a contract with them. What is my next step of action? It's been about 3 months since I've had any contact with them and I am getting a little worried since my wedding is on the 12th of September. I am obviously going to start looking into getting a new one, but what do I do about getting the money back that I put down already with this company?

  • read your contract to see if there is anything regarding pre-event meetings.  If not, they are not in breach of contract and you don't really have cause to terminate.  In any case, it's very unlikely that you will get your money back.

  • Have you tried multiple methods of communication, phone, email, in person?  Does their office have regular scheduled hours?

  • I'd ask on your local board to see if anyone has had experience with this DJ, specifically recently.

  • And yes, I am kind of scared that they may have gone out of business or something bad happened.
  • I need to still go over the ceremony and reception music with them as I didn't have it finalized the first time we met.
  • Your next step would probably be to send a letter to them, giving them a certain amount of time to contact you (maybe 10 days).  Let them know that if they do not contact you within this time frame, you will consider the contract terminated and expect the deposit back.  It may be hard to get it back, but you might be able to take them to small claims court.  Also, book another DJ as soon as you can.
  • If your contract says they will be contacting you monthly beginning 4 months prior to your wedding date, and you haven't heard from them, then that would be a breach of contract considering you are now 2 months out from your wedding date.

  • I'm going through this with my photographer. I sent a similar letter, through certified mail, so I could track the day it was delivered and who signed for it. I have no intentions of getting my deposit back (though it would be nice)...just really want to be done with her.

  • I would deal with this ASAP.  If the DJ isn't going to show, you need to get a move on finding someone else!

    I agree with sending a letter. It seems like you are doing all that you can to get in touch with these people. You deserve your deposit back, but it's unlikely you'll get it back in full if at all. Our venue fell through 5 weeks before our wedding, and it sucks that we only got 1/2 of our deposit back. It was upsetting that they did absolutely nothing for us AND screwed up, yet got to keep 1/2 of the deposit! I'll never understand it.

    Nugget - Oh, I did! I had a near breakdown, but thankfully we were able to book another within 24 hours. We think it worked out for the better anyway, but I was still so pissed and we JUST got 1/2 of our deposit back almost 2 months later. The woman in charge of that venue is unbelievable and shouldn't be in business. She makes me so angry.
