Lost my deposit

I was planning on having my reception at Wedgewood cc and I paid the deposit but NEVER signed a contract. I cancelled my event there but they kept my deposit. Is that right even though I didn't sign anything?

Re: Lost my deposit

  • Is there a certain reason that you had never signed a contract and changed venues?
  • That seems odd that you'd pay a deposit without signing a contract, do you have anything in writing about how much the deposit was and why you were paying it?
  • You can't really cancel an event that you never signed a contract for, right? I would say that money is yours.

  • I'm sure they reserved your date on their event calendar as soon as you gave them a deposit.

If I were you I would keep trying to get it back but I'm not sure you will. Sorry :(

  • I cancelled my event there because things were getting out of hand and with no help I was getting overwhelmed. I thought if I didn't pay the deposit I would loose the space.
Even after visiting the space I didn't sign a contract. I just feel like a smal fish and i don't think I'm going to fight it. My fiance and I are still getting married March 16 and that's what matters.
  • I think it might be worth going to small claims court about. To file is a nominal fee, (like $70 or $80 bucks, I think) and without a signed contrat they would be hard pressed to prove that they should keep it. Just make sure you carefully go over any emails or other communication which may have taken place, to make sure you never gave anything that could be construed as a breach of contract.

  • Why pay a deposit to a place, which implies you'll be using their services, without getting a contract (aka a promise they will follow through with their end of the deal, as well as you following through with your end) to back it up?  It's kind of common sense, to cover your butt & theirs.
