Any developments with your crazy dress lady?

  • Strangely enough, it seems that she finally came to her senses and realised that spending $3000 on lawyers probably wasn't the best option. I haven't heard from her lawyer since he threatened to take me to court of defamation (and wanted $500 payment to resolve that issue on top of the $2500 for the other!). I spoke to my own lawyer who basically advised what we already knew- they were simply using scare tactics, and at the end of the day in matters relating to funds so small, she cannot be represented in court by a lawyer in any case. Even if she did win the case outright, and win damages, the most she could get would be $1000, because damages are scaled based on the size of the initial claim.... So, basically, I am going to be taking her to small claims court soon (will file paperwork when I get a chance) and attempting to recover my deposit.
  • I should add that the lawyers I've consulted with feel that it's highly unlikely she would win, let alone be granted damages. I'm sure when I file the forms, she'll counterfile to attempt to get me to pay the remainder for the dress. Her lawyers can coach her for court, but they cannot represent her, so I feel very confident that I would be well placed to win.
