  Its a very pretty dress. Although, it seems more cocktail style than black tie style, because of the length. Black tie, to me at least, means floor length gowns.

  I think that dress is very appropriate.  I've been to a couple of these "black tie preferred/optional" weddings lately, and that dress would have been fine at any of them.  

  
  

  Since it's your FI's cousin and he's in the wedding party, you could ask him if he's ok with it or if he wants you to look for something longer.  That's been my strategy in this situation.

  FI doesn't care at all. He barely knows his cousin. He and his younger brothers one of which is 14 are the only groomsmen as far as he knows. We assume cousin doesn't have many friends and cousins FI does even sides. Thanks all! I got a 15 off for RTR today so I'm getting this damn dress :
