My venue is closing!! OMGness!

I went to make a payment at our venue today and was informed that the company has been bought out and is being turned into a charter school! They sold all of the contracts to a catering company in town. I  am sooooo- just - speechless. So, now what. We don't like the other catering company or the other place they are sending people to. But, if we cancel, we will breaching the contract. Plus, we can not look for another place because our  deposit money is tied up in this place. Uugh

    Darn, how are you breaching contract when they sold your contract. Def pull out that contract and go through it. There should be some clause. You shouldnt be locked in if they sold your contract. GL girlie, I hope it works out for you!

    Oh wow. I'm guessing from reading this, you probably didn't know your venue was facing financial hardship. Therefore, there could be a way for you to get out of the contract. Did the contract specifically state what you would be getting from them? If the new place doesn't include all of that doesn't that constitute a breach of contract on THEIR part? That wouldn't be fair to basically force you to hold your wedding at a place you don't like. Especially when you're paying them. Double check the contract and talk to the new venue about a refund.

    They sold your contract and didnt tell you...I would check into that and see what can be done...

    Tameric, that sucks..to be blunt.  Sorry to be the bearer of bad news but, you would be breaching contract if you walked away despite the fact your contract was sold. Your vendor did what is called assignment of rights.  In the US, our public policy favors a free flow of commerce and has much to do with the fact that most contract rights are assignable, this includes sales contracts such as the vendor contract (agreement) you and FI probably signed.  Not giving legal advice, just wanted to clear up our concerns.  I know, I know, it completely sucks but read through your contract with a fine tooth comb and see what you can "pick out".  GL

    BTW- check and see if your contract will allow you to transfer the agreement.  A little like subletting an apartment (but not really)- see if you can sell you agreement to another couple.  GL...again:)  HTH

    Aww... sorry to hear that. I agree with all the ladies. Read through the contract carefully and see if there is a 'clause' in there that would allow you to get out if it. If there isn't ,try and express your concerns to the venue and they should be able to at least give you majority if not all of your money so you can look elsewhere.Good Luck!

    I can't believe that them not alerting you to the fact they were going out of business AND selling your contract isn't a breach of contract on their part.  You can always try to bluff them to say you are going to contact your lawyer regarding this matter they may not want the hassle and may let you out.  I'll keep my fingers crossed.

    I agree with pp, speak to them and mention bringing your lawyer into the matter, possibly get a letter drafted from a lawyer and have it sent to them.  It seems that there should be some other way to settle this.  They may work with you on this.  Does the other venue offer services comparable to the original vendor you chose?  If not, I would inquire about differences in services, if there are any.  I would definitely be that annoying squeaky wheel and also post reviews about your experience with the company in the event they attempt to reopen in the future under a similar or different name with the same owners.  Hope it all works out for you.  GL!

    What the vendor did is completely legal.  Right now, you have to focus on the new vendor being able to "live up" to your existing contract.  If the new vendor cannot present what was promised you may have a valid argument.  On the other hand, you mentioned you found out when you went to the vendor- def look into why you were not put on notice regarding the contract being sold.  Think about when your mortgage is sold to another mortgage co. i.e from bank to Wells Fargo  It does not allow you to walk away from the mortgage company and you are put on notice that the change in holders is occurring. 
    If you and FI decide to proceed with legal action, you may want to try a law school in your area - legal clinics at law schools are third year students who are supervised by law profs and will not equal the cost of a Preston Bailey designed wedding (hyperbole, of course).  Your concerns re: this vendor sounds like a straightforward contractual issue and state laws do vary.   GL and do not become discouraged- things will work out- we all will keep you and FI in prayer!     Im sorry that happen to you! I would take it to a lawyer. I know extra money isnt what you want to spend right now, but you need to know your rights. If the service you paid for isn't going to be what you are going to get now, I think that you have an argument.

    I am sorry you're having to deal with this.  The pp gave you excellent advice, so I would start there to know exactly what your rights are and try working with the new vendor to see how they will accommodate your needs.

    Thanks ladies. I'll update you all later. I think the best way for us to go is to see how they can NOT live up to the terms of our contract as some of you have suggested. There are some things that  I know they can not  uphold to do to the difference is the buildings. And if nothing else- I know they are not going to be want to match the price because the new venue is VERY upscale. Thanks again!
