There are times when my stubborn streak worries me

I've been in discussions with my landlord (management company really) over missing a filing with a city agency to maintain my rent stabilized apartment.

I was served with notice that I had to file a PARS to appeal within 25 days.  I was in the hospital (in December) and I didn't get the letter.  It was returned to the city agency, unknown to me.

Since then, my lawyer has been trying to negotiate with the management for me as their stand is to raies my rent to market value because I didn't file.  I've been here since college so my rent is less than a third of what others are paying for this size apartment.  Yes, I have a great deal but the agency is supposed to notify me when/if a PARS could be needed.

Lovely.  The Notice of Termination is signed by the manager who told me last week that there was no problem, not to worry.

  • Wow.. that sucks so much :( I'd fight it as well. I have a serious stubborn streak too, unfortunately (or fortunately, depending on how you see it!).

  • What do you mean it got returned?  How does someone's mail magically get returned to sender?  Even if you didn't have the PO holding, or someone picking it up, it's not like the mail person says "huh, they haven't grabbed their mail in awhile, I guess I'll just send everything back!"  At least, not around here.

    If this is the case, the company should know that she wasn't informed and should have  tried to contact her another way.  It just doesn't make sense to me.
