WWSBD?

Hey all I am coming into an issue with the caterer for the wedding. I am hoping you might be able to give some advice or share your experiences. CN: paid a 2500.00 deposit that says "non refundable" on invoice without signing contract and now can not reach anyone. More details below. We originally decided on a Sept date and a place to hold the wedding. We chose a venue that was owned by a catering service. It was going to be easiest for me since we live 3 hours away. We paid 1/2 of what was owed when we toured the place. When we changed our date to July, they said their venue was booked but we would just use them for catering. We chose a new location and asked for an updated invoice. Thinking that 2500 should just about cover the food for 100 people pasta buffet I was fairly shocked when we received an updated invoice asking for 1,000 more. The per person price increased dramatically several dollars per person as well as having a service charge added. The bottom of the invoice said that the service charge included site tour charges, flatware, silverware, etc.. With the needed dishes and things provided at no cost with our new location I tried to contact them to get a full breakdown. This was roughly a month ago. I copied the owner to an email two weeks ago asking why I was no longer receiving correspondence. She called me and told me that the person handling my file had quit but she would address it. I asked that the few questions service charge break down and options to adjust the menu a bit because of ceremony time changes just be answered by this past Saturday when I had the meeting with the new venue. I have now not received any response again. I have called twice, emailed twice, and texted once in two weeks. We never signed a contract, but the receipt I have says non refundable deposit we were supposed to sign a contract but I lt was never sent to us. How would you proceed? Sorry for any typo or grammatical issue I may have missed. This is from an iPhone.

  • It also appears space and indentation aren't recognized on mobile.

  • I'm so sorry to hear you are having issues.  Ditto JCB.  Keep documenting everything.  Mention that you never signed a contrct and were never kept abreast of everything.  I highly recommend just dropping them altogether and just asking for a refund unless you can get a contract very soon that spells it out clearly and to your satisfaction.  I'd also try and get your hands on a contract.  50% "deposit" seems quite high.  Most places have maybe 10 or 20% that would be nonrefundable.  That's ridiculous.

My dad was generous enough to pay our deposit on his CC. He wanted to do that as a gift, so I should call him. My worry is that if I bring up anything threatening it will be impossible to get it back.

Half seems outrageous to me too, and ditto about calling the credit card company ASAP.
I agree that without an executed contract, they might not have much to hold you to, except the "non refundable" stamp on the invoice. If the supervisor isn't a complete a-hole she might recognize their errors and refund it.
    Good luck!

  • Thank you all, I sent an email requesting a refund by Friday or that I would start a dispute. Do any of you know if there is a time limit on disputes vs. charges made? It was done 11111.

Did you ever sign the invoice?  To me, non refundable has no leg to stand on if they told you it's non refundable AFTER you paid them.
  • No I have never signed anything.

  • The fact that you never signed anything should work to your advantage. I hope you get it all figured out!
