Won't there be an appeal with the Supreme Court now? I think I heard something about that on the radio this morning. Once the SC makes their decision, can it still be appealed after that is their word final?

I think someone asked this... so I'll try to answer. This means the case gets to go to the supreme court. This is good and bad. Bad because they're kinda conservative and might rule against gay marriage. It's good because if they DO vote in the advocates favor, then it could pave the way to legalize gay marriage everywhere. I suck at explaining things, but I gave it my best shot.
It's a huge step in the right direction. Prop 8 should never have existed in the fist place. No one should get to vote on whether or not your marriage is legitmate.
What really p!sses me off about this proposition (aside from everything about it) is how much funding it got from the Morman church... in UTAH. Wtf??
THAT is messed up to me, that some OTHER STATE can get up in our business like that and try to make the first proposition ever to TAKE AWAY and explicity DENY someone rights. W.T.F.

Yeah, that is too bad. I'm not anti-Morman or anything. I'm more so not pleased with the fact that a group of ppl from ANOTHER state got up in our state's business trying to bans OUR gays from marrying.
Even if it was Mormans in Cali opposed to it, then I'd disagree with them, but at least be like "Whatever, they can have their opinion." But for people from ANOTHER state to just get all in it really bothers me.

I wouldn't be upset if people from another State tried to HELP out people in need in other states. Oh Utahians tried to put their fingers all up in New Yorker's business, too, when we were trying to legalize gay marriage. It was annoying, but I was more annoyed by our own New Yorkers trying to fight against it. Everyone is entitled to their own opinion, but when they actively try to infringe upon someone else's equal rights their opinion becomes a problem.

Not the first proposition, the first constitutional amendment. There was a prop in the 70s that specifically wanted to ban gay teachers from teaching in public schools. Ronald Reagan was instrumental in keeping that from passing. Also, CA already denied gay marriage about 10 years ago, but Prop 8 was a constitutional amendment - the "ban" on gay marriage was already on the books.

But they would need another court case to reverse the decision. They can't come back to SCOTUS with THIS particular case and say, "Actually, we want you to think about this decision again." They court can go against their own precedent with another case, but they'd need a compelling reason to do so, since precendent counts for a lot when it comes to the law.
Anyway, I'm kind of surprised that the "Yes on 8" people want to bump it up to the supreme court, but they can appeal if they want to (I just don't see how they can win, and then they run the risk of the opinion overturning every constitutional ban on gay marriage in the US). This decision is very, very specific in how Prop 8 violates constitutional rights, so it would be really, really hard for SCOTUS to somehow make the opposite decision. SCOTUS can also refuse to hear the case (in which case the decision would stand, but it would only affect California). The case was written as it pertains specifically to California, so for now, it doesn't affect any other states.
