Vendor Does Not Provide Contracts - Florist

I have found a florist with good reviews and was also recommended by a friend. We have met in person and I have seen pictures of weddings he has done over the past several decades. However, I just asked him to send me the contract and he responded that they don't have contracts. I am comfortable sending him a single page contract to sign. Any suggestions on what must be included? Has this happened to anyone else? How odd. I want to pay a deposit and it seems very questionable, although reviews and my friend's recommendation say otherwise.

  • The contract should include the deposit, prices including a breakdown of costs, fees (delivery and set up), date, time of delivery, substitutions of flowers incase your flowers are not available (usually it says something like "similar flowers may be substituted in the event original flowers are not available"), refunds (if aplicable) if you choose to go elsewhere after deposit is paid.

I think that was everything I remember being in mine.

  • yes, this is unusual and the detials jagore08 mentioned should be included.  I would let your florist know that it would give you peace of mind to have those things outlined in a quote of some kind.
  • A contract is definitely necessary.  If a formal contract is not put into place and this florist just decides to not do your flowers without telling you or completely flubs the job, you have no legal recourse to try and get a refund etc.

If you really like this florist I would tell him that you understand that he does not usually do contracts but for your peace of mind (and to cover your a$$) you would prefer to have a contract written out with prices and the items you are requesting.

  • Do they do detailed written estimates?  Signed and dated by both parties, this would serve somewhat as a contract.
