Update - Caterer Refund

I called the office and spoke with the new person that was just hired.  I told her the dilemma and asked that she speak with someone about having my funds returned.  She told me that someone would be getting back with me the next day.
A few days went by and I received an email from the owner saying that she was diagnosed with a "life changing illness" and that she understood my position and my funds would be returned.  She mentioned that they would be sending it back in installments. I replied saying that I was sorry for what she is going through, but grateful for her refunding the money.
I was then expecting an email the next day, as promised, for dates of my refund installments. Five days went by and of course nothing, again.  I
sent her an email saying that I should just receive one payment because I can't count on an email being returned, so how can I count on payments?  She emailed me this morning saying that they were not in a financial situatin to be able to do that. I would receive 1/4 back on the dates of May 1, May 15, June 1, and June 15. 
I have made the complaint with the BBB and contacted my Dad (who made this deposit on his CC as a gift to us) about a dispute.  With it being so long since then, a dispute wouldn't do much.  Now that I have in writing that they would be refunding the money, if I don't get it, I can at least pursue a small claims case.  I'm just frustrated with the whole ordeal. My Dad thinks the entire thing is fishy and worried I won't be reimbursed in time for the wedding, and honestly I feel the same way.

  • Wow.  I'm glad you at least have something from them in writing that they will give you your $$ back, but based on prior dealings with them, I'd be shocked if you get it all back without a fight. It sounds like they have some pretty serious financial problems if they are trying to pay you back in payments.  While I totally get the whole life-changing illness thing can be well, life changing and I totally repsect that and know first hand what that's like, but it doesn't give them a free pass to mismanage clients money, which is what it sounds like they are doing.


    Just out of curiousity, have you found an alternate caterer yet, or do you need to wait for them to repay you to do that?  I didn't recall seeing anything in the prior thread about that.  Not that it really matters, I was just hoping that you getting another caterer isn't contigent on getting that money back.

  • I have found someone else.  The new venue we chose has catering and they are going to do it for us.  She knows about the situation and hasn't pushed for more of a deposit yet (we only gave her 550.00 so far). The woman who owns the new business was really helpful at our last meeting.  I have kept her up to date about payments and she has said that we will work it out.  We can cover it if we have to, but I'd really like to avoid dipping into our savings any more than we have. I want there to be some in there by the time the wedding is over.
