What rights do the brides have @Dress shops?

I ordered my dress on 1/26/13, my wedding is 9/14/13 so they had 9 months to order the dress. I just found out the dress is expected the first week of September! We are getting married on an Island so we are leaving for the wedding on 9/11/13. They told me to give my seamstress a 'head up' that this would need 'rush alterations'. When they said 'rush alterations' I was silent, which promted the girl to add "like maybe, one day alterations" (cuz I'm sure I won't be charged extra for that). Obviously, I am not happy. I want to make sure the alterations are done correctly and the dress fits correctly. I don't want to rush the alterations. I have a bit of an odd body shape, very curvy.

Honestly, I didn't have a huge emotional connection to the dress, I'm not really the kind of girl to get teary-eyed over a dress. So I would rather just find another dress and get alterations done in a proper time frame. I paid for the first dress in full, it was $500. I don't expect the dress shop to give me all of my money back but I did expect something. They are not willing to do anything. Playing a waiting game is not an option as I am a 34D bra size, 27" waist and 41" hips, I have a very odd body shape and need GOOD alterations.

So to sum this up; what are my rights with the dress shop. Am I just out $500?

  • Well, when you first ordered the dress, what was the time frame they gave you for getting it in? If they said they'd have it in earlier then you probably have some recourse. Otherwise, I think you're out the full money. I remember when I ordered my dress I had to sign something basically saying "We want our money, if you don't want the dress anymore, tough titties."
  • They told me 6 months but I also signed the stadard 'we want your money' contract. I feeling like I might be S.O.L

    I knew this wedding planning was just going too well. I guess I am taking a trip to Davids Bridal and buying something off the rack!

    Talk to the store manager/owner - the higher up the better - and just explain your situation (don't get pissed or demanding) and what you were told. Let them know you understand what you signed, but were told verbally it would be in 2 months ago. 

    - Tell them you're leaving on the 10th and you need the alterations done by the 9th. (extra buffer day)
    - Tell them you want them to call the manufacturer and find out exactly when the dress will be delivered and make a fitting appointment for that day. If they can't find out now, tell them to do it and call you with an answer.
    - Establish with the store manager/owner that you only want to deal with them on this (no other staff or reps)

    If you go hunting for another dress don't spend a lot. My guess is that if you get the owner on the line, things will get done when you need them to be done.

  • If the store manager/owner won't work with you, try to contact the dress company directly. Tell them your name, what store you ordered the dress through & the number of the dress. Make sure to ask them, when was the order for the dress received to confirm if the dress was ordered back in January when you purchased it. Try to find out from the dress company info on why dress is taking longer then originally advised by the store. I have a feeling the store didn't put in your order when you paid for it. Give the owner a chance/if you don't have a good experience, then I would start dress shopping especially since you will need alterations. You don't want to be having to deal with that the week of your wedding. Then you can pursue legal action against the store. They told you July, it wasn't delivered when promised, that should be some sort of breach of contract.
  • Read your contract. There should be something in there about delivery time. If there is, they are in breach of contract. And you should go marching in there with contract in hand and demand a refund, or that they allow you to purchase another dress at discount.
