AGAIN. Like for fudgsicles sake.

It was stupid too. One of the things his boss has been making him do lately is drive all over town to pick up product they ran out of. He's usually fine with it, but it makes me a little cranky because they don't compensate him for the gas. Anyway, his car was out of gas, we're short on cash, so he says hey, I can't with my car, may I borrow yours? Boss says no, then suspends him for insubordination and not following orders.

What the actual fuck.

  • That is beyond stupid. Why can't the boss order enough supplies/materials so that NO ONE has to drive all over town to pick crap up?

  • I agree, it doesn't sound legal at all. I don't believe they can require him to go and get anything in his own car without compensation since it's not in his job description. You definitely should see if you can get his pay for the time he's not working.

  • That place breaks labour laws all the damn time, so he's been hunting for a new job.  But he wants a job in the administrative assistant field, but he wants to make $35,000.00 and he's entry level. So he's SOL.  Either way, I hate them and I want to egg his boss. Not his house, not his car, just him.  But I won't. (This is probably my 45 minutes of sleep last night talking, but I really do want to throw eggs at him.)

    This is probably my evil side talking... but do it? It's almost Halloween. You can wear a mask and drive by and he'll never know who you are. The only problem I see is that it takes a lot better aim to hit a person than a house. Aim I know I don't have.

  • That sounds highly illegal and I would be mad as hell too! Hmmmmm....we could all join in the egg throwing party. If lots of us are aiming, then surely someone would make contact. (I've got some aggression I would like to let go of and hitting a jerk with an egg should do the trick. lol I'm sorry you and your fiance are going through this. I hope he finds something better soon. In the mean time I would be making some calls to the HR or the Dept of Labor.

    I'll help you throw eggs. I could probably hit a person with an egg - I've played lots of dodgeball-type games with a lot of squirmy, dodgy kids.

    Seriously, FI needs to gtfo and get a job that actually follows the laws.

  • He needs to go over his boss' head. They need to pay him $0.55 per mile or whatever the IRS payment is. Otherwise, you can claim that on your taxes.

  • He can (and should) claim it on his taxes, but his employer's requirement of personal vehicle use is 100% allowable under federal employment laws. It may vary by your state however; some states, like California I believe, mandate that employers have to reimburse mileage, so check your state statutes as well. 

    The IRS rate is guidance for either employers or employees trying to claim a deduction. Employers aren't even required to reimburse at the IRS rate if they do offer reimbursement.

  • Go above the bossman's head.  Whoever is next up the ladder, he should ask for a meeting.
  • This will all depend on whether or not his job description requires him to use his personal vehicle for job purposes. Again he will have to research things. I know in certain jobs I was not allowed to use my personal vehicle to run errands for my boss even if it was job related. Liability issues, if I got hurt, I could then turn around and sue the company. Also, unless all of their deductions add up to more than the standard deductions it is pointless to claim them. Driving for your job can be a big deduction, if you do it every day and put a ton of miles on your car. But it's a pointless deduction if you only do it occasionally. I would still have FI talk to a district manager and bring up concerns about what has been happening. See if that is resolves the issue of a manager that is doing illegal actions.
  • Guys...pretty sure OP is in Canada, different labor laws I think. Also she might not be in Canada and I'm screwing her up with someone else. In which case totally ignore me.

  • What a shitty situation.

    If your FI is looking for admin work, I highly recommend temp agencies. You can get your foot in the door and get some experience, and many places hire temp-to-perm, too. In the meantime it's a good idea for him to brush up on his typing and Microsoft Office skills. There are free online demos for these, which I recommend highly. Most temp agencies make you take a test on basic office stuff and the Office suite, so the more prepared he is, the better chance he'll have of being placed somewhere good/high paying.

    Good luck! This is a blessing in disguise if it lights a fire under his ass to get out of that dead-end job.

  • I would contact employment standards for the province he's in.  Suspensions like this sound like they'd go against what most provinces have in writing, but if you call in, they'll give you information.

    That said, depending on where he's located I can't see finding a 35k admin job difficult.  I am, however, in Alberta where there's a stronger job market.
