Hire a lawyer?

One of my bffs/bm got in a horrible car accident after a chick lost control of her car trying to avoid a bike rider who "came out of nowhere". My friend ended up hitting her head on. Car is totaled, thankfully she's okay, just getting some bruising (it happened Saturday night). She went to her doctor who is prescribing physical therapy, some meds, and obviously not working since she is a bartender and Disney performer. My friend believes the driver was texting. 

I personally think she should hire a lawyer, moreso because she is going to loose out on some serious money from her jobs. At the same time, I have no clue about this stuff and don't even know if it will help or she will be bale to get any money from a law suit. Any thoughts/advise are much appreciated.

  • I would talk to my insurance first, see what her insurance is offering. Then I imagine she'll need to call a lawyer. GL!

  • Yes, I would want someone on my side making sure I wasn't saying, doing, or agreeing to any of the wrong things.

  • I am an attorney but I practice transactional corporate law. I got rear ended last year, and I called a personal injury attorney.

    I felt kind of stupid calling an attorney, but it's absolutely been worth it to have someone with expertise in that area of law handle my case. Plus, I've saved tons of time not having to deal with the insurance companies, and that alone has made it worth it to me.

    Exactly. The insurance companies' ultimate goal is to pay out as little money as they reasonably can. And maybe that's not a big deal if you have a little fender bender, but in an accident with injuries and lost wages I would certainly want someone who is working strictly for my best interest.

  • Call an attorney and let your friend know that there are statute of limitations depending on the state.  So the day of your friend's accident, the clock started ticking on being able to file a lawsuit.  It's usually like a year, but you don't want your friend to have her therapy and then later on realize that she lost a lot of money due to the accident and it's too late to file.

    Any decent lawyer would know to file a subpoena to have her cell records pulled too.
  • Often times, insurance company attorneys also represent the driver of the vehicle when they were not the cause of the accident (she could still hire her own attorney if she wanted to, even if this was an option).  I second the talk to the insurance company first thing.  She may already have a lawyer (whose first client is the insurance company, so she should keep that in mind) that she doesn't need to pay for.

    First make sure that her knowledge that the woman was probably either texting or looking at cell for directions or any possible thing taking her attention from the road, gets into the police report immediately.

    Then your insurance company may have a better chance of representing you , getting an at fault judgement.

    But you need a lawyer for any settlement of lost wages due to injuries.
