Help! Dress contract!

I am really hoping I can do something about this because I have just been ripped off!
My wedding is 18 months away and yesterday my mom and I went into a bridal store just for fun. WELL, I saw a dress, tried it on and had THAT moment. I knew I wanted the dress! We were originally told it was 999, but as I couldn't decide they said "if you take it today it is 425" seemed a little suspicious but I loved it.
It's not that I didn't love the dress but it was that it is still early and I haven't tried on that many dresses yet. But I LOVED it, and it seemed like a steal so I said yes to the dress! The sales woman kept saying "it may not be here later" (typical sales tactics maybe I am dumb for believing her)
Anyway, we pay the deposit (50%) and I come home and try and find pictures of it online, I cannot find it anywhere on the designers website...I figure it must be a clearance and thats why they gave us that price.Anyway, I keep looking and I realize it is actually a bridesmaids dress, from this season, in ivory. This is fine by me, I do not care about these details at all because as I said, I love the dress. However, a few quick searches online tell me the dress retails (at least online, in the U.S.) for $160.00. I called a few different stores in Toronto and they confirm that my same dress, in ivory costs about $220.00 in their stores. I even called the same store I bought it from (anonymously) and they said they would call me back. I called another store from the same chain and they said it is indeed, $220.00 At this point I called back the place we bough it add and told them this. They said I would have to call back on Thursday when the owner is in to discuss with her. I am not sure what to do at this point. I want to cancel my order entirely because I feel they lied to me. I honestly think they were confused at first, then realized the mistake and tried to sell it to me as a "sale" for 425 for a bridal gown even though it is a $220 bridesmaids dress. I know I can get the exact same dress at another store for $220.00. I know I can get it at their other location even for $220! I looked at my receipt and it doesn't say the designer OR the style number anywhere. Furthermore, we don't have a copy of the contract. All the receipt says is "deposit is non-transferable and non-refundable." My mom says she was never given the other sheet of paper she signed. Can we get out of this contract? These vile people do not deserve our business? I am hoping the owner will at least be able to honour the true price, but ideally I don't want anything to do with them now. Is it possible to get out of the contract as it is misrepresentation? If I can't get out of it that is fine, but I am hoping they will not charge me the 425, DOUBLE the actual price. If I can get it for the 220 I will accept that but I will definitely be taking my business elsewhere for alterations and accessories. HELP! What can I do?

  • You mention it is a chain store? Is it possible to contact their district manager or head office about the matter? If this is the case, the reputation of their business is at stake and they should be stepping in. Also you should at least be able to obtain a copy of your original contract from the store. Hopefully upper management or the store owner can resolve this for you. Good luck.
  • Call back when the owner is there. Your first priority is to explain what happened, say you feel deceived, and insist that you are refunded all except the $220 it would cost at their other location. You can also threaten to contest the charge on your credit card statement (or actually do it).

    You signed a legal contract.  You must honor it.  You can ask the store for an adjustment, but they are not legally obligated to do this.  Be very, very nice to the store owner.  Maybe she will make an adjustment for you.

  • If you don't have the designer and style number, you don't know for certain it is the same as the bridesmaid dress.

  • i would try on this same dress at the other store to see for sure its really your dress. the dress you tried on could be very similar to the one you saw online but they are two different dresses.

    one could be the maids dress the one you saw elswhere and this one could be a bridal sample from a few years ago.

    or the shop is truly marking up the prices really high which is wrong.

    my dress is a  julietta 3098 by mori lee there a bunch of dresses that resemble mine some she has done in the past and other designers. after a while same style dresses start to look the same online

    can you provided pictures of the dress you tried on and the designer of the one you saw online
  • I think there is an argument that this contract was fraudulently induced, if it's true that the dress is actually the BM dress.  Come back and post pics so we can help determine if they are the same.
  • If they truly did sell you the same dress then I think you could contest that it was fraudulent and you could probably go as far as going to the designer because most designers do not allow their products to be sold that way. However, are you 150 percent sure it's the same dress? Having worked in a bridal store, there are a LOT of dresses that look similar.
