  • Yes and he said "well...it must have been a hard decision."  I'm kicking myself for not casually saying,"no, actually it wasn't."
  • you might still want to go ahead and start up an EEOC case, though.  If something happens and you find yourself looking again, you can tell the prospective employer that they are welcome to call for a reference but please be aware that you are currently in EEOC proceedings.  plus giving a bad reference is illegal (at least in IL).  If you can catch him doing that (have a friend call and pretend to be new boss and ask questions) you can get him in a lot of trouble.  the only info in IL you can give out is dates of employment, position held, if they are/n't eligible for rehire, and with a signed consent, wage info.
