[QUOTE]In Response to Re: angry : Well I knew it was something like that, but it's just so freaking nosy.  I was just  starting to get over my indignation about being asked if I feel safe at home.  If I say I have a gun are they going to frisk me or ask for serial numbers?  I just want my Pap smear, I don't go there to discuss the 2nd amendment.

Ok, well you're being a bit ridiculous, IMO.  They're there to take care of your health and well being.  So they're going to ask you questions that relate to it.  If you really don't want to discuss it--you know which answer will give them the green light to move along.  Just say "no" and be moving onto the next question.

You could always tell the MD that it's none of her business.  But, yeah, guns at home if you are worried about homicidal or suicidal patients is a huge public safety issue.  Your doctor is not trying to impose on your 2nd amendment rights.  Geez louise.
  • Mica- I have a question.  If a patient is showing suicidal/homicidal tendencies, and the Dr doesnt ask questions like that, can the Dr be held accountable if the patient ends up hurting themselves or others?

IVF #1= BFP. m/c at 7w6d. Needed 2 D&C's and scar tissue removal. Mild OHSS
IVF #2 = BFP. Severe OHSS. 4 Drainings. TWINS!
  • It depends on the state, but in general, yes.  There's a famous case, Tarasoff vs. Board of Regents, where a therapist knew of a client's homicidal tendencies but didn't alert anyone because of patient confidentiality, and the client killed the very person his psychologist knew was at risk.
  • There's a duty to warn and protect.  So if you know your patient has plans to kill his ex girlfriend (or whomever) , you are supposed to figure out if there's a plan for how to murder, try to talk the person out of murder, consider psychiatric commitment of the patient, and contact the intended victim and the authorities.

I've had suicidal patients but not homicidal patients.  You'd better believe I asked the suicidal patients if they had a gun and what their suicide plans were.

  • Mica I figured as such.  With everybody so ready to sue the shiit out of Drs, I dont blame them for covering their asses.

  • Florida tried to make it illegal for physicians to ask patients if they had guns last year.  This was overturned because to make it illegal for us to ask questions would be imposing on our freedom of speech.

I'd say that it would be grossly negligent of a person knowing that his/her patient/client wanted to kill someone to not ask follow up questions such as inquiry about murder method, weapons, etc.
