*** CEW *** HR related question

I have a question about FMLA. I Googled, but I'd like you to confirm that I understand correctly :)

Tim has to go in for surgery and he'll probably need me to stay home during his recovery. Is that covered under FMLA? When I looked it up, it said serious illness and I'm not sure if that would be covered.

I have no vacation time left and I don't trust my HR guy as far as I can throw him. I'd like to be able to walk into his office with as much understanding as possible.

If anyone else has ever used FMLA, your insight would be much appreciated.

  • If it is I got royally screwed over when I was out after my back surgery for 2 months. I filed all the necessary paperwork and was denied.

And betrothed, I'm disgusted with most of the comments that you have posted. I don't think I've ever read such judgmental comments in my life. I'm so lucky that the girls I speak to on theknot are nothing like you...I would've never come on here for ADVICE if I would've encountered a big a bitch as you. I genuinely feel awful for your children or your future children, and I think it would be irresponsible of YOU not to invest in their future therapy sessions starting now. Because trust me when I tell you honey, they're gonna need it. ~jcaruncho2010

Really? Was it FMLA or short term disability? I was covered under STD after my surgery a few years ago.

  • Yes, caring for a loved one can be covered under FMLA. We have several employees that use FMLA for these types of purposes. As long as you've been with your company for 12 months and worked at least 1250 hours during that 12 months, you qualify for 12 weeks of unpaid leave.

I looked up "serious health condition" and it's defined as:

"serious health condition" Under the family/medical leave laws, a serious health condition is an illness, injury, impairment, physical condition, or mental condition that causes a period of incapacity (meaning inability to work, attend school or perform other regular daily activities) and requires at least one of the following:
an overnight stay in a hospital, hospice, or residential medical-care facility (any incapacity or subsequent treatment in connection with the inpatient care is also covered); or
continuing treatment by a health care provider.

    Hope that helps.
  • Cew - you're the bees knees!

    Thanks :)
