help! not sure what to do!

My husband and I are having a bit of an ordeal with one of our "guests" that attended our wedding. Actually the guest was his brother's date. Anyway, she brought her digital camera and we were under the impression that she was just going to take some candid pictures just like most guests do during a wedding. Now, we have come across a Wedding Photography website that is hers, and she is using our photos as advertisement! We were never presented with a contract, and we never gave her permission to use our photos in this way. This makes me very upset. We weren't even aware that she had a wedding photography business. In fact, we didn't even know she was taking pictures until after the wedding! What should we do?

She doesn't have a model release from you and needs to take those pictures down immediately. I would contact her first, and if she isn't reasonable, go to her hosting company for her website and tell them. Last resort, get a lawyer.

Ditto woodfrogs. If she doesn't have a model release, you can demand that she remove them and if not, you have every right to contact an attorney and send a cease and desist letter.

By simply displaying the pictures on the website, there is no need for a model release. If they are using the images as an advertisement then a model release would be required. That being said, I imagine if you ask nicely... they *should* remove them.http://www.danheller.com/model-release-primer.html#7

i had this happen to me; i was in a friend's wedding and the hair stylist took pics and put on her site without my permission.  i told her off big time.  they were down in an hour.  i would ask her immediatly to remove them and that you were hurt she didn't ask your permission.
