attorney or bbb?

Hello,
I'm in a situation that I'm learning is fairly common. My photographer hasn't delivered the goods. Per our contract, we should have had our edited photos by August 18. She had a baby in early August so we've been patient. She texts me from time to time saying she's almost done, and she's told me 3 times since September that they'd be done in another week. Friday night was the last straw. She was supposed to meet my husband and me with a flashdrive of our photos and she completely stood us up. I sent her a tactful but firm email that if I do not have a flashdrive in my hands this week I will be taking action. We have an easy case since she only corresponds by text message and email. My question is what would be the pros and cons of going through the Better Business Bureau vs contacting an attorney? We do not want money, we want our photos. Thank you!

  • Off the top of my head... Attorney: Pro- you are one of a limited number of clients and rules require him to handle your case in a timely manner so he may be able to get results faster Cons- you pay for his services, typical rates are $150-500 per hour (in my area) and that includes writing letters, which would probably be his first step and which may or may not be effective BBB: Pro- you don't have to pay them for anything Con- it may take a long time for you to see results, if you see any at all I would write her a letter outlining all the contacts you've had and the various deadlines she has missed. Then give her a deadline by which to give you your pictures and whatever else she is required to by the contract. State if this isn't done, you will proceed with a complaint to the BBB, contact an attorney, and make it your mission to post feedback about your experience on every website you can find.

  • Thank you for the insights! I actually did the letter already and said I would take action if I didn't have the flashdrive in my hands by Friday. I'm just trying to decide which action to take because the BBB won't accept complaints that are involved in the legal process, I would have to choose one or the other.
