Uggh...Photobooth Vendor

So ladies, I puchased a photobooth groupon back in August for my March wedding. I contacted the vendor via email or phone (can't remember) and I do know that I received email confirmation stating, Hey! Ok I have your date secured and for idle time it will be $75 per hr so just let us know. Thanks!

 Now, fast forward  to yesterday, I emailed to confirm my date and inquire about the photo size to purchase envelopes. Well, I get a reply asking me did I sign a contract because he had 2 brides wanting the date and whoever sent the contract in first received the date. 

Really? Im livid because he never mentioned anything about a damn contract and even on the website it states that 50% deposit holds date AND I have my email confirmation from him, which from a legal standpoint is just as binding as a one page contract he types up. Hell, it even helps me because he didnt limit his liability like he would have with a form contract. 

Now, I'm a lawyer and I haven't told him this yet or other vendors because I feel it's not relevant but I think I need to let Mr. Photobooth know. I don't want a refund but rather the photobooth we contracted  for. My suggestion to him will be to rent one from another vendor and bring it to my reception.

 

Am I going overboard/overreacting? Should I just take my refund? I hate to make a big fuss over $329 and a darn photobooth but I think I need to teach this man a lesson on business management and customer service.
