Hey, This will be quite the initial post really because Im about to tell you a bit about me and mine in order to get as much helpful information as I can with this scenario.
My name is Bethany, I'm originally from Ohio in the USA, however I've spent the majority of the past year in the UK with my, now, fiance. We met online, I'm soon to be 21 and he is 28... within a year of dating we met in person. Two weeks thereafter I left my home to go back with him to England. I stayed a little over five months, then, we came back to America for some visitiation with my family... as well as to follow the border laws set in place by the UKBA.
On the way back into England I had a snag and nearly got deported because apparently according to the agent the 6 month time period where you are legally allowed to reside in the UK is a "generic" term. They say it is put in place there in hopes to sway any complications; I.E tickets, lost passports, and etc. However to stay liesurely for the 6 months is apparently frowned upon.
In any event he did allow me through, but informed me if I stay the full term once more that they will consider it as falsification of facts and will ensure that me and my FI can not get married ever... Which is a snag... because I do intend on staying the full term for quite a few different reasons...
Needless to say this whole experience has been traumatising... I love my man, he's my absolute world... him and his two lovely children. I want to get married in the US, and we will want to bring both of his kids with us. Our plan was to begin applying for the Fiance Visa now, in hopes that the application process will work it's way out by January... which is the next time I have to go back to the US anyways. We would appear before the JOP and do the deed (We would have the big wedding on the date I originally have planned but this is for paperwork) and he would go back to England to work for a couple months. To save up about 6k in USD before moving. During which time I will look for a place for us to live, start up working again and etc. We will hopefully achieve the goal of him moving over sometime in April or May of next year... when the kids are out of school and on their summer holidays that way we can enroll them in the next year rather then do the paperwork of getting them to exchange schools moreso at the end of the school year.
The answers I really need from this board is in order;
1.) Does the UKBA have a say in denying us Fiance/ Marriage Visa's if being married in the USA, or at all for that matter.
2.) Does my plan seem plausible in the slightest? I could use opinions, advice, and any form of help that is possible.
3.) If my plan has holes in it, or needs to be changed in any way... please tell me... I'd like to know now.
4.) What are the complications, if any, that will incur due to the fact that two children are involved... ages 7 and 10.
5.) If you have experience in the matter, and have a better plan... please tell me your experience with it... I would really appreciate it.
6.) Is this the fastest way to go about things? What are my other options?
I know this is normally a board where women get to brag about their engagements and tell stories... I'll write that at another time... right now.. I just really need to know facts, pros and cons, and need advice... so any sort of help would be so so SO appreciated. I'm really quite nervous embarking on this complicated adventure so... reassurance would be good too lol...
Also... I did read the post set in place by Jennadee78.. but from what I read I think our circumstances are a little different... though the post was helpful, I would like to see if further information will come up with what I have put.
