    Eh.  They didnt show up - as I figured.  So now we have a warrant for possession, which basically means the sheriff will come kick them out.   We went through all this before, but last time the day before the sheriff came, they gave us the total they owed us, so we took it.  

    This time as much as I want the money, I also want them gone.. so if they offer to pay prior to being kicked out, I am strongly thinking of not taking it.  As much of a headache as that'll be for me (because it means realistically we won't ever see that money again) - it may be worth just getting them out entirely since they'e proven they'll just do it all over again.   

    So yeah.. house will revert back to us in about 2 weeks, and then we can re-rent it out to someone new if we don't decide to let them stay.  It's still a trainwreck (they don't take care of it at ALL) so it's going to take some good time to get it cleaned up and back to be rentable (which is partially why we let them stay last time, we didn't want to deal with the cleanup).

    eh. the loss and clean up will probably be worth getting rid of them in the end. Sorry you are having such a problem with them.

    Doesn't a warrant go out for their arrest if they miss a court appearance?

    Also, if they don't pay you for the damages, can't you take them to small claims and get a judgement against them? I know that doesn't mean you will get the cash, but at least you can screw their credit up.

    The whole situation sucks :(

    If they miss court, it just means the judgement is found in our favor to return posession of the house to us - and they can't contest it.   

    We can 100% go after them for the damages/back rent/etc, and already have the paperwork to fill out to do so..  But it's hard because the guy just got laid off from his job, and I imagine theres not much money in the bank - so garnishing wages/bank accounts may not result in much for us.  It's still worth doing, and we will definitely be doing it.  But like they said, it's hard to get water from a rock ;)   

    Thanks for the support!  I feel like I am constantly evicting these people, it's such a neverending battle with them.

    These were the same people you had evicted before right?
    Hopefully you can get the right people in next time.
    I would not be able to clean up after people like that.

    Yep, same people.. last time they paid up in full before the actual eviction took place (after court, but before the sheriff literally kicks their butts out) .. so we called off the eviction and let them stay.  Literally 2 months later we're back in court with them for not paying.  So needless to say I don't trust them at all, I gave them one shot and they blew it.  (Well, I gave them about 20 shots, but this was the final one in my opinion).

    Yeah it's going be hard to clean up the house.. Especially because DH built part of that house himself, added an addition, did tile work, etc... it's going to make him sick what all his hard work has turned into.

    Wow. I don't understand how people can be disrespect to people and other people's property. When I moved out of my apartment I scrubbed it clean. It was cleaner when I left than when I moved it.
    How can they live in a place that is disgusting.
    Have you seen it recently to see how bad it is?

    Yeah we were there a few weeks ago for something.. it was bad.  I mean, these people seriously don't clean, don't throw out the trash, leave food and drinks out, cigarette butts and stains everywhere, house wreaks of smoke even though our lease states no-smoking, the food then leads to bugs which are all over, they don't clean up after their dog...sidenote - the dog is apparently NOT house trained which is a whole other issue of new carpeting, flooring, etc etc etc etc. It's just overall DIRTY.
