  • I agree w/WDC about the contingency.  Even if you have a lawyer on contingency (they get % of recovery, nothing if you lose), you still would have to pay litigation costs (court reporters, private investigator, medical records, experts) out of pocket, outside of attorney fees.  If these guys are going to jail, there isn't going to be anything to garnish.  I would look into it, and figure out what kind of resources they have, but I wouldn't spend money on it unless you're sure they have some to recover.  Unless they own property, they're probably judgment proof.

  • Oh my God. This is just awful. People like this don't even deserve to be alive. I have no advice but I wanted to say I am sorry and I hope your brother and his girlfriend can get the justice they deserve.

  • Leah - One of the guys who did this owns the house where the party took place. That was brought up when we were talking about a civil case today, I just didn't put two and two together.

  • No legal advice here. Only sympathy, hopes and wishes. Those guys are aholes. Hopefully they will both recover quickly without too much long-term damage. Your family will be in my thoughts, as well. Good luck.
  • good luck supporting DH too.  I know if this was my FI it would be really difficult to keep him from going after those guys.

That was brought up when we were talking about a civil case today, I just didn't put two and two together.If you get a judgment, you can put a lien on their house.  That will make them pay. :) Even if your bro spent every dime on medical bills, watching that SOB lose his house would be pretty freaking awesome. 
  • Oh, and you might already know about this, or your H's family, but this might come in handy for them:[url]http://www.dps.mo.gov/cvc/[/url]  They can get some help with medical bills and such.  I didn't look closely enough to see exactly how it works in MO but MN has a similar program that's great.  There's more info if you follow a link, and an attorney should be able to answer any questions they might have, as well.

  • lpstl, I don't know if they could file a restraining order on his behalf (it's probably not necessary in A's case, because I'm assuming hospital security is competent to keep A safe), but they would help the witnesses.  If they have a TRO and the attackers come around to threaten them again, they'll probably be held in contempt of the order and either fined or thrown in jail, depending on the seriousness of the offense.

  • JK - That's a great resource, thank you again!A has health insurance, but medical expenses are going to be outrageous. We know he'll be in the ICU for at least two more weeks before he's transferred to a regular bed. Then he has to have surgery for his jaw, which will result in it being wired shut for 4-6 weeks. The drs are hoping he won't need any reconstructive surgery on his face, but it's a waiting game. He'll also need to get several teeth replaced. Oh, and I forgot, they also tried to stab him, luckily he was still fighting them off at that point so it only resulted in a laceration across his abdomen.

  • Brie - That's a good idea about the witnesses getting restraining orders, I'll bring that up with everyone tomorrow.

  • I've never filed one in MO, but in the state I did they tend to be very basic--just fill out a short form at the courthouse and basically get it stamped by the magistrate.  It'll only be effective for a short period of time until they can get to trial for a permanent order, but it's a good protection to have in place.Plus, then should the guys come around (even just driving by in their car) the witnesses can call 911 and state it's a TRO violation and the police should act pretty quickly.

  • Oh my god, I am so so sorry. I feel literally sick to my stomach reading that. Getting beaten like that is one of my biggest fears in life. I pray he makes a complete recovery.

  • Holy shitza batman. I am sorry about what happend to your bil and his gf. I hope the people who did this to him spend a lot of time in jail sitting next to bubba the badas$. I hope your bil recovers quickly he'll be in my thoughts.
