I was wondering, after you mentioned it in the dress post, what ever happened with crazy dress store lady?

    WELL... 

     

    So far, not a whole lot. I went through the office of fair trading mediation. Basically, she is insistent that because she hired that lawyer to harass me (to try and get me to sign the confidentiality agreement, basically) and apparently spent $3000 on doing so, that she is not returning my deposit because, clearly, it's 'not her fault' that the company 'lost her order' (despite the fact she never received an order confirmation email to evidence the fact she ever ordered it when she said she did). She doesn't seem to get the fact that because I ordered it from her, it is her that was responsible for delivering it on time, thus her that I hold accountable. She also kept repeating that if I'd wanted the dress, I could have 'paid the small legal fee sum' (hello $2000) to have it, or signed the agreement. Yeah, no. So at the end of the day, we went back and forth and I made numerous offers (first the dress back, given she said it's useless to her because of size- she refused. Then my deposit, and then finally half of my deposit, both of which she also refused), and we couldn't come to an agreement, so the issue was recorded as unresolved and it's up to me to file the matter in small claims court. She's also refusing to actually let me sight the dress, so for all I know, it never arrived at all. I know by the principle of it all, I really should continue on to small claims- but it's so much time and emotional effort to do so, and so at this stage I'm sitting on it for the moment. I am just so over preparing documents etc, and at the end of the day in small claims court, the magistrate isn't going to read over our 30 pages of emails.. magistrates in small claims in my experience generally just rule in whatever way is beneficial for both parties, thus if I'm going to go through this all only to get a little of my deposit back (particularly given I'll need to take time off work etc), I don't see it as particularly worthwhile. 

     

    It's $700 total, and yeah it sucks to lose that, but I don't know that I want to spend more than that in time off work etc trying to recover it. Even based on principal alone, she has a legal bill that is well and truly above the cost of the dress. Clearly, that's not my problem (there was no need whatsoever to hire a lawyer, aside from her guilt and inability to talk to me about the issue herself), but it does make the cruel, evil part of me sleep a little better at night.

  • Hm.  Well, if you aren't going to take her to claims court, I would find some way to spread around what a biznatch she is.  Perhaps a well placed call to the newspaper for a community piece would be good.
  • My BIL's fiance keeps asking if I want to go on a TV show we have here called 'today tonight', which is basically just trashy current affairs in which disgruntled friends/employees/customers go on and bitch. I don't know if I could lower myself to that, though! haha. 
  • If it's trashy, I wouldn't either.  If it were something like, say, 60 minutes... sure! lol
  • hahaha well we have 60 minutes here, too. It's only part-way trashy, but BIL's Fi doesn't have a relative who works there to get me on it easily!
