    I think you misunderstand the first amendment.  The first amendment protects the right speech free from the the abridgment of government officials (politicians, police officers, etc.).  However, not every word you say is protected.  "Fighting words", such as insults that are meant to inflame rather than to show a POV, are not protected by the constitution.  So even if TK were an agent of the government (which it's not, it can ban you for violating its own TOS which don't necessarily have to comply with the laws--you agreed by contract to not call people names, and you have violated that which means TK is now free to ban you from posting on its site), you still wouldn't be protected from being banninated, which really I think you deserve at this point. <div>

    "Troll" is a term for someone who just stirs up shiit on the boards.  It's not a name, it's a behaviour.  There was even an article about trolling on Facebook today in the NY Times and they even used and defined the term "troll" numerous times in the article.   • well thats not how she came across. How am I supossed to know theres a dictionary meaning for troll, if there even is one. I actually took offense to being called a troll. I actually had to look through pictures on facebook and delete the ones where I look like a troll. She made me an emotional wreck over it, and no i hate myself!

    That's an interesting question.  On the one hand, you don't have to be a member to read anything on here so in that respect the boards are effectively open to the public, yet on the other hand you have to open an account and agree to the TOS before you post anything, and your posts are subject to moderation and deletion.  So I'm gonna go ahead and cast my lot with "private" and distinguish it from public boards because, while anyone can read, not everyone can post.  (This is, btw, two years after I took con law so I'm just pulling this out of thin air).  So since it's private, TK can abridge your speech to a much greater degree than a public forum could.  Since the 1A's primary concern is the protection of political speech, and Style's speech is not making any discernible political point, it can be limited, censored, and abridged.<div>

    Good bar exam answer.  Address both sides before coming to a conclusion.  Just don't forget IRAC and you'll be fine.  You'll be astonished at how many rules you have to write out for the bar questions.

    Please give the definitions of strict scrutiny, intermediate scrutiny and the rational basis test.  Which applies to commercial speech?  Which applies to political speech?  Which applies to interoffice memos?

    Lame but it's the easiest way to rack up the points.  I think what I settled on for the OH and PA bars was CRAC.

  • The instructor I worked for last year was partial to CREAC and I've gotta say I prefer it--much more thorough but still brief at the same time.
