Disastrous Experience After Sales with a Bill Levkoff Dress

I purchased a Bill Levkoff dress at Charme Bridal at Hamilton Mill  Rd, Buford - Georgia and,   unbeknownst to me, it was a  "sample" dress. When I was at home I noticed it had the word "SAMPLE"  EMBROIDERED ON THE OUTSIDE,  IN LARGE LETTERS.

I returned to the store but the store owner has refused to exchange it or give me my money back. She was extremely rude and would not even talk to me about it, even though the dress cannot be used.

I have already sent 3 messages to Bill Levkoff contact email and no answer at all until now.  What an disappointment!

    Is the word "SAMPLE" literally embroidered on the dress?  How did you not notice that when you tried the dress on?

    That's very odd. I've never seen a dress with the word "sample" embroidered on the outside. Can you have someone skilled unpick the embroidery. But generally, if you walk out of a salon with a brand name dress, it's a sample, and sold as is. Your argument here is with the boutique, not the brand. You are not bill Levkoff's customer, the salon is, and you are the salon's customer. Do you have any friends who are lawyers? I have no idea what contract law is like in GA (I expect they made you sign some sort of waiver when you purchased it?). I think it there's something really obvious on the outside of the dress that you didn't notice when you tried it on (?) and wasn't pointed out to you, you may be able to threaten legal action if your concern is not addressed. And because I'm such a sticky beak, do you have a photo of this embroidery? Maybe some of us can give you advice on what to do about it.

    I've seen that embroidery before at a dress store.

    Did you order the dress and go back to pick it up or did you try it on and buy it on the spot? If you bought the sample on the spot, the typical deal is that you're buying it as is-- scuffs, pulls, runs, and embroidery included. If so, a seamstress might be able to pull out the 'SAMPLE' stitching.

    If you ordered a new version of the sample and they gave you the sample instead then you probably have grounds for legal action.

    I re-read you OP.  So, you had no idea that they were selling you a sample dress?  Sorry, my previous post sounded a bit bitchy, but it seems like perhaps the salon took advantage of you, as you believed you were getting a new dress, and they gave you a sample without explaining that to you.

    Did you order the dress and go home and come back later to pick it up, only to be given the sample?  Or did you buy it off the rack?  If you saw it, tried it on, and took it home on the same day, I don't know how you wouldn't have known it was a sample.  And I cannot imagine you not noticing SAMPLE embroidered on the outside. Like, how is it possible to miss that?

    I would visit several seamstresses in your area and inquire about pulling out the SAMPLE embroidery. Unfortunately, when buying a sample gown you agree to take it as is. At least a seamstress may be able to fix it.
