  • @charlotte98975 it's called earnest money for a reason, and her inability to meet financial standards means a giant hell to the no!
    When I sold my house my first buyers backed out and I remember my realtor saying that if they fought on the earnest money then the house couldn't be released back as being available on the market until it was sorted out so I may have to decide which I wanted more - the earnest money or having it ready to sell again. In the end they didn't fight me and I got to keep it which was good since the house had already gone stale a bit and it took a while to sell

    @kvruns - what kind of a grinch cuts Christmas lights? I mean do yours blink or are they super colored or otherwise look like a slot machine (like my neighbors)? Because I could see how a neighbor would be bothered by that. But be an adult and talk! Don't snip!

    My boss is out of the office today, so it's nice and quiet around here. I did come in late though because I drove most of the way here with my dog in the back of my car....I forgot to stop by doggy daycare and drop her off. She was so quiet in the back. LOL! So I had to turn around and backtrack.

  • @charlotte989875, I'm disappointed and pissed for you all!  It's so much time wasted and now we are smack dab in the slow season for real estate.  Nonetheless, there are always buyers looking and I hope the next one, with an even better offer, comes soon.

    And now for my long blab about earnest money, gifting and seasoning of down payment funds, lol.

    As for keeping the earnest money, if you all haven't already, carefully read that part of the PA.  It should be, black and white, right in there.  I've signed PAs that were carte blanche in regards to financing, ie if my financing fell through up to the closing date itself, I got my earnest money back.  I signed a PA that had a financing contingency, but there was a time limit with it, ie only 10 business days to invoke it.  I also bought a house through an auction site and there was NO financing (or inspection) contingency whatsoever.  If I pulled out of the deal for any reason, the earnest money was lost.

    At least where I live, most PAs for owner-occupied family residences tend to be very generous in the buyer getting their earnest money back when a deal falls through.  And the earnest money really only protects a seller from the buyer changing their mind.  But that could be different in your area and there aren't any hard and fast rules about it either.  It will be whatever the buyer/seller agree to in the PA. 

    I feel like there are shenanigans going on, on the part of the sister.  Because it is odd she won't disclose, even if that means her sister can't buy the house.  My mom loaned me some of my down payment for my personal home 6+ years ago.  She had to write a gift letter AND provide either one or two months of bank statements, showing where that money came from.  However, my lender very CLEARLY explained all of that to us, from the get-go.

    I remember him also telling me that, if I get any kind of money that I am going to deposit into my account...other than my paycheck...to either hold it until after closing or I'd have to write a letter for EACH deposit as to what it was and where it came from.  Even small deposits.

    As an aside, when I'm trying to get financing for one of my investment properties, I'm blunt with my mortgager.  I tell them that I really don't keep much money in my accounts, because I prefer to put extra funds toward my debts.  But I can pull money out of my line of credit for the down payment.  So, "You tell me how much you all want to see in my account and how long you want it seasoned to be approved for this loan."  LMAO.  For some lenders it doesn't need to be "seasoned" at all.  For others, it is usually 1-2 months.

    Moral of the story.  Unfortunately, nothing is certain until the closing has happened.  Deals fall through in underwriting for all kinds of crazy reasons.  And underwriting typically doesn't happen until the middle-end/end :(

  • @MissKittyDanger It was a clean cut, and on a tree next to the house, so only someone all up in our yard would have been near it (the neighbors on that side are actually gone for an extended time due to a home reno project gone bad). 

    My H said it had happened before years ago on a different one. Most likely teens/young adults out for "fun".

    And I promised to take her and her BFF roller skating tonight.

    Also, my day is being punctuated by squeaky noises, because my cats have cornered a mouse in the basement, and I can't effing find it.  I saw it, it got away because I wasn't looking for it, I don't know where the cats put it, but they keep finding it, it squeaks, and they let it go again.  I'm afraid they're going to put it in my bed, because, cats-  fuzzy little jackasses.(wait, am I allowed to call them jackasses?)

    Cats can be so funny when they catch prey!  At a previous house, with a mouse problem, I watched my cat kill a mouse twice.  She was an older kitten at the time.  Still so little and cute!  But don't let that sweet, happy face fool you.

    It wasn't enough to just kill the mouse.  Oh no, no.  Where is the fun in that?  She had to torture it for awhile, for her own amusement.

    She'd catch it with her paw.  Then let it go.  Just to smack it with her paw again.  She also had a maneuver where she would hit it from the side instead of on top, so it would go sliding across the floor.  Then run and pounce on it again.

    When the poor creature finally died and wasn't moving anymore, she was bored.  Walked away and left it wherever it had stopped moving.  But at least she didn't bring the "gift" or store it somewhere.

    I wondered if any mice had ever gotten away from her in the "playing".  Sounds like maybe that is what is happening with your cats.

    I know it would have been kinder for me to kill the mice, once she caught them.  OMG, I just couldn't.  More because they're yucky and can move, as opposed to any moral compass I have (or don't) about killing mice.

    Yes they can be jackasses.

    Tell your cats to stop playing with it. Worked with a former cat of ours. We'd empty-threaten him by saying to kill it or we will.

    Re: bank stuff. I went to deposit H's paycheck, like I always do with it all signed and everything, and the teller is asking me various questions like if we'd gotten a check from them before. Duh, every month for the past year! They were going to put a hold on it, but he said he wouldn't if he could find another deposit. He did, so they didn't hold it, but what? Makes no sense.

    Re: bank stuff. I went to deposit H's paycheck, like I always do with it all signed and everything, and the teller is asking me various questions like if we'd gotten a check from them before. Duh, every month for the past year! They were going to put a hold on it, but he said he wouldn't if he could find another deposit. He did, so they didn't hold it, but what? Makes no sense. 

    I was a teller for three years in my youth for B of A and Wells Fargo.  I mean, I would sometimes have to put a hold on someone's deposit, but it was always based on

    • balance in person's account at time of deposit
    • What the check was, ie personal check vs. business vs. gov't/money order/cashier's check

    Plus, as long as someone's account wasn't in the negative, anything under $500 wasn't even looked at as far as holds go.  That was CA.  In Louisiana, things are decidedly more draconian.  I've had tellers hassle me because the check I want to cash is $20 more than what is in my account.

    Speaking of holds, my bank put a hold on a POSTAL MONEY ORDER last month.  Except it had been deposited in the ATM, so it wasn't like someone could have informed us right then and there.

    In fact, we never got ANY notification that a hold had been placed.  Which is against Federal banking laws or at least it was when I used to work for B of A.  I had debits bouncing all over the place.

    They ended up reversing all the bounced check charges because I hadn't received a notification.  But I was on the phone for 30 minutes to make that happen.

    The person I spoke to the most was such a complete moron, I just can't even.  I kept repeating...over and over again...that the fees needed to be reversed because they violated Federal banking laws in regards to hold notifications.  He kept repeating to me that, if I had just signed up for their text notifications, I would have known about the hold.

    Text notifications!?!?  GTFO.  Texting didn't even exist when those laws were put into place.  I don't have to sign up for JACK for it to be "oh, too bad for you".  The notification has to be mailed to the address on file.

    And no, not e-mail, regular mail.  Oh...poor little guy...have you ever wondered what that box on your house is for?  It's for regular effing mail, jacka**.

    I didn't actually call him names or use curse words, though that was a struggle.  But, at one point, I did finally say something like, "Look, you have absolutely no idea what you are talking about.  And I am NOT talking to you about this anymore.  Please transfer me to that other department (one he had already mentioned)."

    My other banking annoyance?  Apparently, to deposit cash into a personal account, it can ONLY be the person whose account it is and they have to show ID.  Yes, cash, smh.  We found that little gem out when my H went to go deposit some rent money we had received in cash and was not allowed to, because he isn't on that account.

    When I could finally get to the bank...days later...I grilled the teller about the reason for this asinine policy.  And when did it happen.  Because I've never heard of it.  Being polite.  Not raising my voice.  But wanting answers.

    At one point, a platform person came over to give me a "better" explanation.  She said it had to do with money laundering.  To which I replied, "Except people can deposit cash into business accounts without this requirement.  You know...business accounts...where 99% of money laundering is done.  So, again, why have you all chosen to make your customers' lives more difficult for no reason?"  She told me "I'd be surprised" and gave me the impression it was a federal requirement that happened 2-3 years ago.  But, I'm not so sure about the federal part.  I think it is just their policy and would swear I've deposited cash in personal accounts at other banks, without showing my ID.

    I think you may be right. We have had some issues depositing money in our son's account over the last year. For years we never had problems depositing money in our kids accounts (very handy when they are in college lol) but then all of a sudden it is a major PITA.

    I think we only need to worry about a banhammer, if a cat logs in and complains about that post to the powers that be.  But I wouldn't put it past one.

    To your first point, we've been living paycheck to paycheck for a while now, so the check has been more than what's in our account just about every month in the past year. And second point, yea, my H has gotten the exact same check from the exact same company all year. It made no sense.
