  • Did you sign a contract with the store? If so, dig that out and read all the fine print. Chances are that if you need to change the dress you'll lose the deposit on the first dress. Depends on if it's gone into production or not.

    If the store is really making your life difficult I'd contact the BBB.

    </div><div>If you signed a contract stating you were responsible for the full amount then you're responsible.  They can sue you and/or put a negative on your credit report if you don't pay up.</div><div>
    </div><div>If the contract says they won't order until 50% is down you can walk away or try to get your $ back but honestly you'd likely have a long and brutal customer service battle and possibly ultimately take them to small claims court which you still might lose and then you'll also be out court costs.</div>

Now I am really irritated - I am now going to have a dress I just don't love.  What irritates me even more is that I was told the dress wouldn't be ordered until I had 50 % down. I need some advice on how to handle this situation.

    It sounds like your dress was ordered, if they told you that it would be ready in August. I would read your contract but I would guess if the shop has started to make your dress you are on the hook for at least your deposit if not the full $750.

    Did you actually cancel your wedding or did you just change your mind?

  • I filled out the information card with my information on it, that's it.  The only other thing I signed was the credit card receipt for the $250 charge to my debit card.  I was told verbally by the consultant that nothing would be ordered until I had 50% down on the dress - well $250 is not 50% - $375 is.

    I changed my mind but told them I was canceling the wedding, so as far as they are concerned the wedding was canceled.  

    I am ok with being out the $250 - the dresses I am looking at are much much cheaper and in the end the new dress and the deposit will most likely come to around $500 which is still cheaper than the $750 plus alterations.

    I just don't know what I can do at this point - I don't want the dress and I don't want to be out the $750.
  • You will most likely just lose the deposit.  They can't force you to come in and pick up the dress and pay the other $500.00.  The only thing they could try to do is sue you for the other $500.00.  A business going to that much effort over $500.00 would be unlikely.  They will probably just try to resell the dress off the rack.   

    The other possibility is that they try to charge your credit card without your consent.   That is unethical and illegal, but I've seen it happen.  If you think they are the type of folks who woulld do that, you may want to cancel that card or report it lost so you can get a card with a new number. 

    Very often, the terms & conditions for their gown purchases are on the credit card receipt or order form.  Did you look at anything or sign anything that specified what dress and what size you ordered?   Most of the time, the terms of the sale are on that piece of paper.    

    Either way though...  If you really don't like the dress, I would tell them that you have no intention on coming to get the dress, and you were told that the dress would not be ordered until you came in and put the remainder of the 50% down, and that you are going to just walk away from the $250.00 and will tell your friends and family how poorly you feel like you have been treated.   

    Then, just walk away from the $250.00 and let the rest play out. 

    Just a heads up though... if anyone says "your dress will be here by X date", that means they are ordering your dress.    Once you order a dress, there is no refunds.  Unless you go to David's Bridal, who has thousands of dresses in process at all times, these dresses are pretty much made when the order is placed.    So, when you pick your next dress, be VERY sure that's the one you want.

    This is a problem. I would see what you have in writing so its not your word against the consultants.

    Uh, don't order  your next dress.  Make sure it has minimal alterations.  You wouldn't believe the stuff that keeps bridal shops in business.  They increase the measurements so you have to alter the dress and pay more money.  They say your dress will be ready in so many months and then they substitute another cheaper dress and since its been so long and the bride is already stress she doesn't know any different.  With my dress I bought it off the rack and am having it hemmed and using leftover material to have cap sleeves made.  Make sure you report this company to the BBB and give them an online review if you can.
  • You really should only be losing the deposit. Thats the reason they have a deposit in the first place. You pay the deposit for this reason, so that if you change your mind they are not out the entire price of the dress. Also, when a dress is canceled they end up reselling the dress in a store as a sample, which means it is slightly at discount. They will literally be reselling an unused dress. I dont see why they would be seeking legal action to get the rest of their money simply because the deposit is in place for this reason. 
    I wouldn't pay/pick up the dress unless I was contacted by a higher authority. There is no reason you should be paying more than that deposit. Thats how venues work also, you lose what you have already paid for.

    I attached the receipt.  The only thing I signed was the little credit card receipt and wasn't given the full receipt until after that was signed and I was ready to walk out the door.  Also note that the receipt your seeing is for the very first dress - can't believe they actually sold this to me, while it was a pretty dress when I got home and really looked at the pictures it looked horrible.  So the dress we are discussing is dress #2.  They never sent a new receipt to me so I have nothing saying I purchased it.

    What also irritates me is that my consultant told me in the dressing room, that they do not order dresses until there is 50% down on the dress.  That is exactly why I put $250 down, as 50% of the second dress would be $375, so it never should have been ordered.  They can't say they ordered it to make sure I had it in enough time for the wedding because my receipt clearly states the date of my wedding of 5/18/2013.

    I specifically didn't put down 50% because I knew that things happen and quite honestly I didn't need to have the dress go into production just yet, it was 14mo before the wedding.

    When I called to cancel the dress and was told no is when I told them about the family member being sick and we were cancelling  the wedding  - this isn't a full lie I actually do have a cousin who was just diagnosed with Hodgkins.

    This all comes down to principle - the dress should never have been ordered as I didn't put the full deposit down.

    So you're mad they sold you a dress that YOU told them you wanted.  Then you paid money for it.  Money exchanged hands, you signed the receipt, you have a contract.  The dress was ordered because you paid for part of it.  You shouldn't have ordered a dress you didn't like. 

    Then you called and LIED to them saying your wedding is cancelled, and when they wouldn't cancel the order and refund your money, you ordered another dress from them?
