  • I live in CA and I am ECSTATIC! Of course it's unconstitutional to deny equal rights to a subset.

  • Someone on P&CE  says this ruling still has to go through the SCOTUS and that they might overturn.

  • According to this CNN article, the decision could be appealed next to the 9th Circuit Court of Appeals, and then to the Supreme Court. http://www.cnn.com/2010/US/08/04/prop.8.next/

    Really?  I have to do some research. For the life of me, I just don't get the entire argument against gay marriage in the first place.  It just enrages me.  Does anyone have any idea of where the S.C. judges stand on the issue?

    Well... it doesn't have to.

    The circuit 9 court of appeals can refuse to hear the case, which means that the California court's ruling stands and will apply only to California (for now). I *think* they could also hear it/uphold it (the 9th circuit court is fairly "liberal") and then deny an appeal to SCOTUS, OR SCOTUS could refuse to hear the case, which would mean the 9th circuit's ruling would be the end.

    Personally, I don't think I want it to go to SCOTUS. With the make up of the court, the best case scenario is that they'll maintain the status quo - allowing individual states to decide on gay marriage. (If the SCOTUS were more "liberal" I'd say push it through and see if they overturn DOMA and/or legalize gay marriage in the entire US. That's just a very, very slim possibility at the moment.)

    Isn't SCOTUS  fairly liberal now? I admit I have about a 2% knowledge of or judicial system.

    It depends on the topic, but it would probably be about 5-4 in favor of prop 8 (or at least against overturning DOMA). With justices, they don't campaign or state their politics, so you have to go with their previous decisions to see if they're pro-gay marriage, anti-abortion, pro-gun rights, etc. Sometimes it backfires. Nixon ended up appointing a few justices that were fairly "liberal" and Reagan appointed Sandra Day O'Connor who was moderate/liberal.

  •  I remember that mentioned before (you have to go by past decisions) Well hopefully it will stick. Some of the comments on a few of the news sites are pretty sad/terrible.

  • I am so happy about this. CA holds a special place in my heart (for being my birth state and place I recently lived in for a couple of years) and I cried tears of sadness when Prop 8 passed. One of my good friends in CA married his BF the day before the election just in case it passed.

    I hope this wakes up other states and they get their heads of their asses.

    I, too, am nervous about this one.  The effect has been stayed until the appeals court rules, so it won't go into effect immediately.  And I would be very nervous about having it go before the current Supreme Court.  An adverse decision would stay in effect for years.

    On a lighter note, when my wife and I got married, I kiddingly asked my son whether he had noticed Civilization as We Know It ending.  He thought for a moment, then said, "Well, I did hear something, but I thought it was just [my brother] and [my sister] throwing pine cones at each other."
