    A prenup could streamline and make things easier. And once Fufu arrives, it'll be even more complicated. In fact Wifey wants to update our paperwork to refelect that I'm the other intended parent. Because, ok check this out, if lets say Wifey goes through the pregnancy the worst most awfulest thing ever happens and she passes away during child birth, but Fufu survives. I currently have no legal right to Fufu. She's not biologically mine and you can't adopt a child until it is born. So...I'm just Fufu's mom's wife. I'm Fufu's step-mom at best in our current state, and in Texas I've got as much legal right as the lady in the next bed. Fufu would actually go to her biological father, aka: the sperm donor. Because he has more legal rights then I do.

    In California I'd be considered the intended parent since I impregnated Wifey. In Arizona, I'm step-mom. In Texas, I'm the nice lady who lives with them.

    Pre-nups and wills aren't just about $$ and divorce. We're having it stated in as many places as possilbe, as many times as possible, I'm Fufu's other mother. In our prenup it states something along the lines (in legalese) "Any children conceived during the marriage of Fiona and Sophia are intended to be raised by both Fiona and Sophia". It might not hold up in every court, but it is something. 
    I swear this was a lifetime movie in like 2003. The baby went to the biological mom's parents, and not her partner.

    Magic- come to Massachusetts!  I know it's the arctic right now, but it's beautiful in the summer, and not too hot like Arizona. :)

    ETA: Like Fran, Magic, and Jells have said, a prenup is not a divorce contract. It's  an amendment to the marriage laws of your state.

  • We have one. It protects you in other ways. It will protect you from taking on the other persons debt they had before the wedding of you get divorced. However this does not include the wealth and debt you create once you are married.

    We got one because I have a small business and he has a lot more money and property then I do. I think it's a great idea.

    Someone said to me the day I signed it, "oh m so glad you planning for your marriage to end". " that's what a prenup does." I smiled and said "not quite... But thanks for your concern, just protecting what's mine, unlike you, who didn't have anything to protect" and just like that she never brought it up again.

    My prenup does keep the wealth and debt gained during the marriage separate. It specifically calls out that our state recognizes debt and wealth gained during the marriage as community property and we intend to not follow state law to keep all of our assets out of the community property "bucket" and waive our rights to each other's property (of course our prenup has important legal jargon. LOL) We have separate everything with the exception of our primary residence.
